Lay Low for a while.
I have a few friends who Plague the Eq2 Forums, and in the news it had this:

I don't know what Sony is going to do, i saw it and i thought i would let you guys know. Ether they won't care and let us be, or they come after us. I don't know about you guys, but the first one sounds better. I can only imagine how hard it is to make a MMORPG Emu, so i just don't want all the work going to waste... and because i need a free way of playing this game!

I remember you that when you enter client you accept and eula, anyone read it?
Following the MaNGOS example (I hope I can talk here of an emulator for another game), Theluda consulted lawyers and decided to separate the project. The site only have the core source, then there's another site for scripts and another (well 3 or 4, that's up to the people) for DB.

hi all. been lurking on the forums for a while
You really have nothing to worry about. It would cost alot more to take anyone to court than they could ever hope to get out of you guys. Plus it just looks bad to their users. The ELUA on eq2 only says 'you cant use anything on this cd'. The ELUA still says CD if you get it online so just dont distribute the cd and your fine, for now
I doubt youll ever hear from sony.

Ok, for sake of not arguing this, we really dont know what SOE may or may not do when this project takes hold and becomes popular. At its current state, they're not worried, but when we have like 200+ active players, things change.
200x 14.95 = 2990 per month
That may not be alot, but to SOE, money is money, and thats thier money as far as they are concerned, and we are costing them 3000 per month from lack of subscription fees.
Again, we do not know what may happen down the road with SOE and ourselves, or if we may be able to co-exist with-out death threats right and left.

A company like SOE would not C&D a little project like this to acquire money. It would be to stop the process (hence, C&D). However, as many, many, MANY discussions like this have been had on nearly every emulator forum I have ever visited, it's pointless.
Like a sleeping giant, they will only care if you kick them in the balls - hard. So far, the only cases I've ever heard of are those SERVERS (not dev teams) that obviously hijacked a major corporations funds. Blizzard with a wow emu, and SOE with WR EQ1 emu. Any other sitings that validate this concern?

If SoE hasn't taken down EQEmu, I doubt they'll do anything about EQ2Emu.
It's up to the player to provide the client, and all the emu does is give the client the info it asks for and works with the info the client gives it. It's not any different that having two different databases that works with MS Access.
However, the EQ2 Emu website owner has to be aware of copyright infringement of certain images displayed on the website. Though I doubt this would be much of a problem.
Because it's open source, the only way EQ2Emu would be illegal is if LE started charging for subscriptions.
