Is this actually legal to play if I have TSO from sony( Unpatched, fresh install. Never been defiled by them)? Just wondering before I try it out.

Nothing illegal here. You bought your TSO box set, it's yours, you can do what you want with it. SOE got your money, I'm sure that made them very happy.
